AMENDMENTS TO THE TERS REGULATIONS
Please take note of the following amendments to the TERS Regulations as published on 16 April 2020:
(1) TERS claims are compulsory (clause 3.1). The employer is now legally obliged to apply for TERS benefits obo employees on temporary lay-off.
(2) TERS claims apply to forced annual leave (clause 5.4). If the employer granted paid leave it must be reversed and an application for TERS must be submitted. However, the regulations allow an employer to recover any leave already paid from the benefit amount paid out.
(3) Employers are "urged" to pay in advance of TERS payments (clause 5.5) and recover payments from the benefit amount when paid out.
